Consumer Guarantees
The Australian Consumer Law (“ACL”) protects consumers by giving them certain guaranteed rights when they buy goods. For example, the Law requires that goods must be free of defects and do what they are meant to do. These rights, which the Law says automatically apply whenever goods are supplied to a consumer, are called ‘Consumer Guarantees’.
Consumer guarantees do not apply if you:
- change your mind, found the product cheaper elsewhere, or decided you don't like or need the product
- have misused the product and have caused or contributed to the failure of the goods, for example, by damaging or misusing the goods.
All claims need to have proof of purchase. The best proof of purchase is a tax invoice or receipt. Others include a receipt number or a credit card statement.
Remedy
Major failures
The Consumer has the right to choose the remedy
- get a refund
- swap them for an identical replacement (if you can reasonably get one)
- keep the goods and be compensated for any drop in value
Minor failures
The Supplier has the right to choose the remedy
- provide a refund
- replace the goods
